The implementation of the 2025 U.S. trade policy has led to a significant increase in tariffs across various sectors, resulting in higher costs for importers and U.S. consumers. Many businesses are now exploring strategies to mitigate these financial burdens, with one potential solution being "tariff engineering."
Understanding Tariff Engineering
Tariff engineering refers to the process of modifying a product’s design or composition at the manufacturing level to achieve a different tariff classification that may result in lower duties. While not all products can be altered in a way that changes their classification, some offer opportunities for adjustments that can lead to significant cost savings.
For example, products like handheld swimming pool skimmers, which are primarily made of aluminum, are classified as aluminum products and are subject to corresponding tariffs. Since their composition is straightforward, there is little flexibility in reclassification. However, other products may have room for strategic modifications that do not compromise functionality but allow them to be categorized under a different tariff code.
A Real-World Example
One case our firm handled involved a cosmetic bag typically found in department stores, often given as a promotional gift during special sales events. Originally, this bag had a water-resistant coating applied to its interior while the exterior retained the texture of a textile. Under this configuration, it was classified as a textile product, resulting in a specific tariff rate.
By making a simple adjustment at the production stage—reversing the placement of the water-resistant coating so that it was applied to the exterior instead—the bag's classification changed. Instead of being categorized as a textile, it was now considered a plastic-coated product. This reclassification led to a new tariff code with a lower duty rate, ultimately saving the importer hundreds of thousands of dollars.
The Potential for Cost Savings
While tariff engineering does not guarantee lower duty payments in every case, careful planning and analysis can uncover opportunities for significant savings. The key lies in understanding how tariff classifications work and how product modifications can align with different classifications.
Businesses that explore tariff engineering can potentially reduce costs, improve profit margins, and maintain competitive pricing for their customers. Given the rising costs associated with increased tariffs, these strategies can make a substantial difference in overall expenses.
