Tariff Classification: How Misclassification Can Lead to Costly Penalties

Correct tariff classification is essential for determining the duties and taxes owed on imported goods. U.S. Customs and Border Protection (CBP) uses the Harmonized Tariff Schedule (HTS) to classify products and assess the appropriate duty rates. However, misclassification of goods is a common error, and it can lead to costly penalties and delays in customs clearance. In addition to penalties and delays, misclassification can also lead to liquidated damages claims, increased scrutiny on future shipments, and possible seizure of goods if classification is deemed fraudulent or negligent.


Tariff classification requires understanding the specific features and uses of a product to assign it the correct HTS code. For example, a smartphone may be classified differently than a basic cell phone or a tablet, based on its capabilities and intended use. Misclassification often occurs when businesses fail to consider these distinctions, leading to the application of incorrect duty rates.


To avoid misclassification, importers should review the HTS codes for their products and ensure that the descriptions match the physical characteristics and intended uses of the goods. Importers should also stay updated on changes to the HTS, as codes and classifications can be revised to reflect new technologies or trade agreements. For instance, the introduction of new types of electronic devices or changes in tariff rates under the USMCA may require reclassification of products.


By taking the time to correctly classify goods, businesses can avoid the financial and legal repercussions of misclassification, including fines, penalties, and delays in the customs clearance process.
