Antidumping and Countervailing Duties: What Importers Need to Know

clarkespositolaw

Antidumping (AD) and countervailing (CV) duties are special tariffs imposed on imported goods that are being sold at less than fair market value or that benefit from unfair subsidies in the exporting country. These duties are designed to protect U.S. industries from unfair competition and ensure a level playing field in the marketplace. For importers, understanding when AD/CV duties apply is critical for avoiding unexpected costs and compliance issues.

The U.S. Department of Commerce and the International Trade Commission (ITC) are responsible for determining when antidumping or countervailing duties should be imposed. These duties often apply to specific products from certain countries that have been found to engage in unfair trade practices. For example, steel products from certain countries may be subject to AD/CV duties if the foreign producers receive government subsidies or engage in dumping.

When importing goods that may be subject to AD/CV duties, businesses must carefully review the applicable duty rates and ensure that the correct amounts are paid at the time of import. Failing to pay these duties can result in severe penalties, including fines, seizure of goods, and the potential for long-term restrictions on importing from the offending country.

Importers can avoid issues related to AD/CV duties by staying informed about trade investigations and rulings that affect their products. Our firm can help you ensure compliance and reduce the risk of penalties. Have questions? Give our office a call today at (917) 546-6997, we would be happy to speak with you.
